FACTCHECKED by USATODAY - This is Part 2 "What Happens If Donald Trump Does Not Concede" our grade? - YouTube https://www.youtube.com/watch?v=yuYubl2lq3w Transcript: (00:00) hello everybody i'm shane vaughn a small town mississippi preacher that pastors a very small church and i've always been on facebook for my ministry a very small audience there um and a few days ago something happened something very strange happened um and this is part two to a video that i made about four days ago entitled what happens if donald trump does not concede the presidency by january the 20th i was talking in that video to my small little facebook audience that i've had for 10 years my family my friends church members (01:03) ministry partners that's who that video was intended for it was not intended to be a total treatise on the house of representatives or anything like that it was going to be a quick little throw out video giving some of our local church folks hope that the presidential race still had some hope in it that's all it was well the rest is history almost between youtube parlor facebook almost 10 million views in four days so the other day someone told me they said there's a newspaper i mean a online news article that was written and the title (02:04) of it is who is shane vaughn and i'm like you've got to be kidding how did i be how did i get on i i didn't i this was not in the plan i'm i'm coming to a story here that of that you need to hear so i was freaking out because i never intended for my simple suggestion of what could possibly happen to become viral youtube considers a viral video to be 5 000 views per hour or more well ours is still currently getting about 11 000 views an hour just on youtube so i just found out uh yesterday that we were on some radio stations (03:00) i didn't know about that but tonight i found out that yours truly little mississippi preacher boy was in usa today i didn't know this until about 30 minutes ago and so i run over to usa today and i'm like they've got my name in usa today a little nobody and all i am is my greatest accomplishment in life is being karen's husband that's and and children to my boys sure enough i'm on usa today and guess what i was fact checked by usa today so i couldn't believe my little video got fact checked by usa today so after i got over the (03:53) shock i wanted to see what they had to say i'm going to link to the article below this video i did not get a failing grade so i'm super proud right now they didn't find it false or misleading but they did give me missing context that was my great so i'm thankful for that because i am a preacher and i don't like to lie i don't like to tell miss truths so i have probably had 3 000 questions since we posted that video about the technicalities of what would happen and how all of this could happen so this video is to give you (04:42) the technicalities the first video now this video is going to be longer because everybody they loved the first video it was seven minutes long well listen you got to be patient seven minutes how am i supposed to explain how all of that happens well the article in usa today said that that was the problem with my video it didn't explain how all of this could happen so therefore it was missing context so this video is the context because i don't want to disappoint anybody and not give you the details before i go any further (05:21) thank you all for spreading the word and giving hope for the presidency of donald trump and listen i don't claim to be a scholar i i have a degree in biblical studies and theology i am not a constitutional scholar i'm simply a a man that knows how to study and knows how to research and so tonight we are going to go into the details i have researched and i have found more details about this so before we go any further i just want to say to everybody watching i was not the first one that came up with this no nancy pelosi was (06:14) you may not remember before the election she said now i'm gonna have to read my notes a lot this is not like the first video just a quick get it and go y'all are forcing me to bring out the details so that's what we're gonna do also in the first video i made two freudian slips i'm getting old and i said that there was 475 in the house there was i meant to say 435 i said 475 mistake and then i said that there was 37 republican states actually i should have said 27. (06:47) so please forgive those mistakes i'll try my best to be more careful i didn't know that millions of y'all was going to say see this or i would have been more careful okay because my local people they're more forgiving than some of you guys are so nancy pelosi said before the election that this could very easily be thrown to the house president donald trump said in his campaign one night that this could be thrown to the house well i'm sorry if i have ears like a radar and i picked up on that and i didn't let it go i wanted to know (07:27) what they meant by that because i love my nation i love my constitution so i begin to study study study on what does that mean thrown to the house nancy pelosi wrote a letter to house democrats and she detailed a situation that has not arisen for more than a century in which neither joe biden nor president trump were to win the 270 electoral votes required to win a majority if that happens a newly elected house would decide the fate of the presidency in january with each state casting a single vote as required by the 12th (08:10) amendment now if you look at your screen everybody i'm fixing to show you the exact letter that nancy pelosi wrote saying what their plan was and when you read this letter you're going to understand why hillary clinton told joe biden do not concede here was the plan are you ready here's her letter quote unquote instead of giving every member of congress a vote the 12th amendment gives each state one vote which is determined by a vote of the state's delegation pelosi of california said to her fellow house democrats (08:55) in other words how many state delegations the democrats win in the upcoming election could determine who our next president is that was the plan folks we win more seats at least 20 to 40 we sweep the house we make the states out balance the red states and we give this presidency to joe biden so according to the usa today fact check they told they made it plain we were not wrong that it could be thrown to the house they did say it's highly unlikely and i never said that it was more than likely all i said was this is 2020. this is (09:51) donald trump nothing surprises me in 2020. also if we get to the point and this is what i said in the first video that we do not have a certified elector because of judicial proceedings or because of state legislatures getting involved because they see voter irregularity whatever whatever whatever happens that does not give the candidate 270 certified votes we fall into the conundrum of it being thrown to the house take that up with nancy pelosi or donald trump this is a fact and even usa today acknowledge that is a fact (10:40) but how does it work that is the question that i want to answer for you right now so to do that we got to look at someone said on youtube in response to my video they said the only way that it goes to the house is if there's a tie that is not correct what is a tie a tie is a conundrum a tie is an unworkable situation it doesn't give you the 270 that you need yes the 12th amendment specifically says a tie but if we understand what the tie means it means you don't have a majority of the electoral votes so the way that this gets thrown to the (11:36) house is when no candidate wins a majority of the electoral college at this moment that i'm making this video on november the 14th 2020 no candidate neither one joe biden or donald trump has a majority of the electoral votes nobody has that we do not have a president elect at this moment we have a president select selected by the media and the the um the swamp the i'll take that back let me take that back for some of you watching but we have a president elect that's been hand selected from a projection that we believe is faulty so (12:21) technically neither man has qualified for the presidency if we get up to december the 14th and we find ourselves in that same situation it gets thrown to the house unless hopefully the state legislature in pennsylvania which is republican-led would step in and and take over for their state and fix the problem and get rid of those horrible votes that shouldn't have been counted so if they get involved then we don't have to go to the house but if they don't it's going to get thrown to the house now the new house of (13:07) representatives a lot of people are confused with the number i gave 27. the house is made up of 50 states yes you have many more democrats in the house than you do republican and so many people said why did you mention hillary clinton telling joe biden not to concede the election if she knew that the house had an imbalance of republican states the answer is very simple she just like you and i were led to believe that the democrats were going to sweep the house they were going to pick up 20 to 40 new seats they were going to take the senate and (14:01) the white house so she was speaking from the same aspirations that we had that the democrats would take that balance of power in the house but the total opposite happened didn't it the republicans picked up 14 seats which did what it caused the house now to have more republican votes or delegations by the state every state gets one vote no matter how many democrats how many republicans hopefully i don't have to go into right now because i don't want to get tedious with this and explain how that works but i'll be (14:40) happy to if you need me but suffice it to say if one delegation or a state has more republicans in the total delegation from the state then that's considered a red state at the time that the new members of the house are sworn in on january the 3rd there will be more republican states in the house than there are democrat i hope that clears some of that up so the new house goes in on january the 3rd and then they will count the electoral votes the new house not the one in there now on january the 6th ladies and gentlemen if that date rolls (15:24) around december the 14th is the cutoff date for the states to certify their electoral college january the 6th is the end of the process for the house of representatives they have to vote on that slate of electors now if that happens it would take a majority of republicans to vote in donald trump that will happen if it goes that far believe that okay well you say i don't want to just believe that okay let's make it plain would you as a republican representative that's there for the people and behalf of the people (16:10) turn against the people and not vote for the people's president you'd be a fool and you would commit political suicide so they're going to vote for donald trump now a so-called contingent election is very rare it happened in 1800 it took 36 votes in the house before thomas jefferson was chosen as president it's only happened one time since then in 1824 so how can a contingent election happen there are four ways that we're going to look at it today first if there was a tie in the electoral college then it would go to the house (16:55) second if there was three or more candidates that they need let's just say we had a third party candidate in the mix and neither one of those three could get to that 270 majority it goes to the house the house votes but there's a third and interesting way that this could happen they're called faithless electors now some people are very confused by a supreme court ruling not long ago they think that that did away with faithless electors but it didn't it just gave the state more power to vet their electors or to (17:35) cabinet they are cabin them as it's called but faithless presidential's electors what they do when you go to vote on november the 3rd you did not vote for a president or vice president you voted for a slate of electors to go and vote on behalf of your state nine times out of ten they're going to vote the way the majority voted but 1 times out of 10 and it's happened i can give you all the dates when it's happened it has happened and folks this is 2020. (18:16) really i don't even need to say anything else it can happen this is not the election to say what can and cannot happen a faithless elector can go in there and can cause this scenario now the fourth is if the house was to reject some of the electoral votes and deny any of the candidates an overwhelming majority i foresee that in this year with so much litigation and so many recounts let me just explain something real quick about the recounts georgia was automatic why 0. (19:01) 5 percent is their trigger for an automatic recount if it's automatic the presidential team or campaign does not have to pay for it free of charge now there's another trigger point above that 0.5 percent in certain states where you can still request a recount pennsylvania is in that margin now the campaign of donald trump would have to pay for it but don't worry we'll all pitch in and pay for that arizona same thing so we know these states are headed for a recount you would have to have your head in a hole not to concede that fact this is time consuming and we have (19:51) no time so ladies and gentlemen the possibilities are endless but the constitution is ready for those endless possibilities we will have a president and it will be according to the constitution but nancy pelosi warned you donald trump warned you it was going to be thrown to the house were you not listening so i come on and make a little video just following up on what they said and it went totally unbelievably bat crazy viral and there's a reason i believe for that many of us believe in our hearts that philadelphia (20:38) is a nightmare president trump said it bad things happen in philadelphia we believe this entire election hinges on philadelphia we believe that will be litigated to the supreme court and if there is no resolve it's going to the house why is that so hard for us to comprehend because it's never happened i get that so usa today i hope that this has added some context to our first video and now maybe we can get a better grade so before i go none of this may happen but all of it may happen
