Treating the Articles as if they never passed the House at all. TOTO: Issa said it plainly: The Constitution doesn’t spell out what to do when you’ve wrongfully indicted somebody. An impeachment is basically an indictment. And it’s an indictment you can’t really be acquitted from. If you are impeached by the House — where do you go to get your reputation back? TOTO: The case has never been stronger. Tulsi Gabbard recently declassified documents revealing a coordinated effort inside the intelligence community to manufacture the conspiracy used to impeach Trump in 2019. The anonymous whistleblower had no firsthand knowledge. Biased officials shaped the complaint. Trump was denied the right to confront his accusers. United States Constitution: The Times, Places and Manner of holding Elections for Senators and Representatives shall be prescribed in each State by the Legislature thereof. THE LEGISLATURE THEREOF. Not voters in a referendum. Not an independent commission. Not a federal judge. Not a Secretary of State. The legislature. Because the legislature is DIRECTLY ACCOUNTABLE to the voters. If voters don’t like the map — they vote out the legislature. That is the republic. That is the design. TOTO: In Virginia — Democrats spent $100 million on a referendum designed to give themselves 10 of 11 congressional seats. One party. Drawing their own maps. Through a ballot measure. And Alexandria calls THAT democracy. The Virginia Supreme Court called it something else. Unconstitutional. Void. Without legal efficacy. The elites who chose for the voters were not the Republican legislators following Article I Section 4. The elites were the Democrat operatives who spent $100 million to confuse Virginia voters into approving the most extreme gerrymander in state history. Class dismissed. [ OZ MUSIC STING OUT ] DEEP DIVE #1: A DAY LATE AND A DONALD SHORT — WHAT VIRGINIA DID THAT 2020 NEVER DID TOTO: May 8th, 2026. The Supreme Court of Virginia handed down a 4-to-3 ruling — a 46-page opinion by Justice D. Arthur Kelsey — that threw out an election the Democrats already won. Read that again slowly. They threw out an election the Democrats already won. Three million people voted. Yes carried by three points. Governor Spanberger called it a mandate. And the court looked at all of that and said four words: Constitutions should not be changed lightly. The vote is void. The map is dead. Four Republican congressional seats — saved. TOTO: What did Virginia Democrats actually do? In October 2025 — with early voting ALREADY underway — they rammed through the first passage of a constitutional amendment. More than 1.3 million Virginians had already cast their ballots before the General Assembly held the first vote. Virginia’s constitution requires an intervening election between the two passages. They skipped it. Justice Kelsey’s ruling: that violation incurably taints the resulting referendum vote and nullifies its legal efficacy. They spent $100 million. Virginia taxpayers got a $5.2 million special election bill. All of it — void. TOTO: Now here is the part that should make your blood boil. This is EXACTLY what should have happened in 2020. Pennsylvania — Kathy Boockvar rewrote ballot ID rules two days before the election. A court later confirmed she lacked statutory authority. The Pennsylvania Supreme Court extended the mail-in deadline three days past Election Day — violating Article II. Michigan — Benson mailed absentee applications without legislative authorization. Wisconsin — drop box rules rewritten without the legislature. Georgia — signature verification bypassed by consent decree. The same constitutional violation. State after state. And every court in America blinked. Standing. Laches. Too late. The Texas case at SCOTUS — dismissed. Never reached the merits. TOTO: The difference between 2020 and 2026 is not evidence. It is COURAGE. The Virginia Supreme Court did what no 2020 court had the spine to do — it ruled that the process matters more than the result. Even when 3 million people vote. Even when Yes wins. If the constitutional process was broken — the vote is void. That is the republic. That is what it looks like when it has a spine. And I will say it plainly: this is exactly what should have happened in Pennsylvania. In Michigan. In Wisconsin. In Georgia. In 2020. Elections do not legitimize themselves. Elections are legitimized by the rules under which they are conducted. Break the rules — and the election is not an election. It is a coronation dressed up in ballot boxes. The majority does not have the power to break the rules. That is the whole point of having a constitution. [ TRANSITION STING ] DEEP DIVE #2: REDISTRICTING — NEW YORK AND VIRGINIA BOTH DEAD TOTO: Let me complete the redistricting picture tonight with what is happening in New York. Because Hakeem Jeffries is desperate. DESPERATE. The kind of desperate where you watch a man in real time admit he has nothing left. TOTO: After watching Virginia’s gerrymander die on May 8th — after watching SCOTUS block New York’s racial gerrymander steal on March 2nd — Jeffries officially announced the New York Democracy Project. He dispatched Congressman Joe Morelle to Albany to meet with Governor Hochul and legislative leaders. The mission: pick up three new Democrat seats by amending the New York State Constitution to allow mid-decade redistricting. TOTO: The roadblock? The New York Constitution itself. In 2014 — voters approved an amendment that created an Independent Redistricting Commission AND explicitly prohibited mid-decade redistricting. To change it Jeffries needs: a constitutional amendment passed by TWO separately elected legislatures — one this year, one after 2026 — then approved by voters in a referendum. Earliest possible date: November 2027. Earliest possible new maps: 2028. The New York map cannot change in time for 2026. Period. Full stop. Morelle himself admitted it — saying he wants to protect voters in 2026, 2028, and beyond. By his own admission — he is conceding the 2026 maps are already settled. TOTO: And Kathy Hochul stood at a microphone and said: I don’t feel like I should be handcuffed in a fight for our democracy. I think all’s fair in love and war. We did not start this. Donald Trump started this. Translation: the Constitution we wrote, passed, and sold to voters in 2014 — we want to burn it down because it is no longer convenient. That is the modern Democrat Party. They write the law to look noble. They break the law the moment it stops benefiting them. And then they call it democracy. TOTO: Even Democrat-aligned Citizens Union Executive Director Grace Rauh said: It is imperative that New York lawmakers not harm their own voters. And they would be harming their own voters if they move forward with a plan to abandon the safeguards currently in place. Even Senate Majority Leader Andrea Stewart-Cousins — a Democrat — when asked directly said: We have not had a real discussion about what we might be willing to do. Translation: Hakeem, please stop calling. We cannot help you. TOTO: And breaking today — and Toto-Town I need you to feel the weight of this — the Missouri Supreme Court has UNANIMOUSLY upheld the GOP congressional map. Not 4-3. Not 5-2. UNANIMOUS. Every justice. In three consolidated cases. Same-day rulings after oral arguments this morning. TOTO: Let me tell you what the Democrats tried to do to stop this map. An organization called People Not Politicians showed up with 691 boxes of petitions — over 300,000 signatures — trying to freeze the map through a referendum gambit. DEAD. They challenged the map on compactness grounds. DEAD. The court ruled the new map is statistically MORE compact than the 2022 map AND the 2012 map. County splits dropped from 9 to 5. Municipal splits dropped from 31 to 13. Democrats lost the math fight. They lost the legal fight. They lost the referendum fight. They lost everything. Unanimously. I am acknowledging the nation YAHWEH raised up. Honoring the covenant framework He established. Submitting to the authority He ordained. And when I pledge allegiance to ONE NATION UNDER YAHWEH — I am declaring that my ultimate authority is NOT the flag. NOT the government. NOT the Constitution. But the GOD who authorized all three. The nation is under YAHWEH — not equal to Him. Not above Him. UNDER Him. That is not idolatry. That is the constitutional order of a covenant nation. PART 2: THE GREATEST AMERICA THAT EVER EXISTED — WHAT 150,000 BUILT TOTO: And now — the flag leads us directly into the question at the heart of tonight’s broadcast. When was America at her greatest? Not her loudest. Not her most diverse. When was America GREAT? TOTO: If you ask the men who built this country with their hands — if you ask the widows who remember when a single paycheck could buy a house, raise a family, send the kids to college, and still leave something in the savings account — they will all tell you the same thing. America was greatest between 1924 and 1965. And that was no accident. That was the direct result of an immigration philosophy the modern political class has spent sixty years trying to make you forget. That is a country at the peak of human civilization. And it was built under a policy the modern academic class now sneers at. TOTO: The pre-1965 framework worked for six reasons. Time to assimilate — slow immigration gave newcomers time to learn English, adopt American customs, integrate into civic life. Wages stayed high — limited labor supply meant employers competed for workers, not the other way around. That is the entire mechanism that built the middle class. Housing stayed affordable — population growth driven by births rather than mass migration. Civic identity remained coherent — Americans shared a common language, a common framework, a common cultural memory. Schools could educate — one curriculum, one language, broadly similar civic backgrounds. And political trust existed. Americans trusted each other. That trust was not magic. It was the product of shared experience, shared identity, and shared sacrifice. PART 3: THE LIE AT LIBERTY ISLAND TOTO: And then came October 3rd, 1965. Lyndon Johnson stood on Liberty Island and looked the American people in the eye and said — and I am quoting directly from the official record: “This bill that we will sign today is not a revolutionary bill. It does not affect the lives of millions. It will not reshape the structure of our daily lives, or really add importantly to either our wealth or our power.” TOTO: That was the President of the United States. Standing beneath the Statue of Liberty. Lying to the American people. Senator Ted Kennedy doubled down: Our cities will not be flooded with a million immigrants annually. The ethnic mix of this country will not be upset. His brother Robert Kennedy confirmed it: the distribution of limited quota immigration can have no significant effect on the ethnic balance of the United States. TOTO: Three of the most powerful men in American politics. All three. Catastrophically. Demonstrably. Historically wrong. Was that miscalculation? Was that political naivete? TOTO: The foreign-born population of the United States surged from 9.6 million in 1960 to over 53.3 million by 2025 — a record high representing 15.8% of the total population. By 2024, immigrants and their U.S.-born children numbered more than 93 million people — fully 28% of the total U.S. population. The decade-by-decade numbers: 856,000 in the 1940s. Over 10 million in the 2000s. A twelvefold increase. And the composition flipped: European share went from 75% in 1960 to 12% by 2010. Latin American went from 9% to 53%. That is not minor adjustment. That is the largest demographic transformation in American history — imposed on the American people without their informed consent.
