TOTO: Good evening, America. I'm Professor
Toto — the Watchman of We the People, the
Connoisseur of Common Sense — broadcasting

TOTO: Yesterday was Memorial Day. And
something stopped me cold. Right in the middle
of the celebration. Right in the middle of the
flags and the music and the tributes to the
fallen. Something I have heard a thousand
times suddenly landed differently. The National
Anthem ended. And I realized something that
most Americans never stop to consider.
TOTO: The Star Spangled Banner — our
National Anthem — ends with a QUESTION.
Not a declaration. Not a triumphant statement.
A question. Francis Scott Key was on a British
ship watching the bombardment of Fort
McHenry. Through the smoke and the rockets
and the bombs bursting in air — he could not
see clearly whether the flag was still standing.
And he wrote what he felt in that moment. He
asked:
“Oh say does that Star Spangled Banner
yet wave — o’er the land of the free and
the home of the brave?”
TOTO: That question has never been
answered. Not in the song. Not on the page.
Because it was never meant to be answered by
Francis Scott Key. It was meant to be answered
by every generation that came after him. By
your grandfather’s generation. By your father’s
generation. By YOUR generation. By THIS
generation. The question is not historical. The
question is permanent. And every generation of
Americans must look at what they have
inherited — look at what they have done with it
— and answer YES or NO.

the foundation of everything you will hear
tonight. A banner not under YAHWEH is NOT
the banner yet waving. One nation UNDER
YAHWEH — that is the banner. Not one nation
under government. Not one nation under elites.

anyone can sign onto. ONE NATION. UNDER
YAHWEH. That is the only banner worth
defending. And tonight we are going to find out
who is trying to tear it down — and what our
generation must do to answer YES.

RIGHTS BILL — 198 DEMOCRATS VOTE NO
TOTO: The United States House of
Representatives has passed a major bill
requiring schools to get EXPLICIT parental
permission before changing a student’s gender
identity, pronouns, or name. The vote: 217 to
198. Nearly every Democrat in the House —
198 of them — voted NO. Only 8 broke ranks to
support it.
TOTO: Read that again. One hundred and
ninety-eight Democrat members of Congress
voted to allow schools to secretly change your
child’s gender identity — without your
knowledge — without your consent — without
even telling you it happened. They voted to give
the school more authority over your child’s
identity than you have as a parent. One
hundred and ninety-eight of them. On the
record. By name. In the permanent record of
the United States Congress.
TOTO: This is not a fringe position in the
Democrat Party. This IS the Democrat Party.
The party that screams about democracy and
the will of the people just voted — 198 to 8 —
against the most basic democratic principle in
human civilization: that parents have authority
over their own children. They are not hiding

DEEP DIVE #1: SETTLERS NOT
IMMIGRANTS — NANCY MACE, GORSUCH,
AND THE BLOODRIGHT TRUTH
TOTO: Let me start with a video that dropped
this week. Congresswoman Nancy Mace of
South Carolina introduced a joint resolution to
bar foreign-born U.S. citizens from serving in
Congress, the federal judiciary, and as Senate-
confirmed political appointees. Her targets:
Ilhan Omar, Shri Thanedar, Pramila Jayapal —
all of whom she says have divided loyalties.
Watch her make the argument.

TOTO: Now — before I go any further —
Professor Toto needs to make a constitutional
correction. Because this is a teaching moment
and intellectual honesty demands precision.
Nancy Mace says the Constitution already bars
the foreign-born from the presidency. And I
have to correct that — because it is not exactly
right. And when we are making constitutional
arguments — exactly right is the only standard
that matters.
TOTO: Here is the exact text. Article II.
Section 1. Clause 5. Word for word from the
Constitution of the United States:
"No Person except a natural born Citizen, or a
Citizen of the United States, at the time of
the Adoption of this Constitution, shall be
eligible to the Office of President; neither
shall any Person be eligible to that Office who
shall not have attained to the Age of thirty
five Years, and been fourteen Years a
Resident within the United States."
TOTO: The key words are NATURAL BORN.
Not foreign born. NATURAL BORN. And here is
the constitutional distinction that most people
miss entirely. A person can be born in a foreign
country — and still be a natural born citizen. If
EITHER of their parents is an American citizen
— that child is a natural born citizen regardless
of where on earth they were born. You get your
birthright from EITHER parent. Not both.
Either. Conversely — a person can be born on
American soil — and NOT be a natural born
citizen — if neither parent is a citizen. Birth
location alone does not determine natural born
status. Parentage matters. Bloodright matters.
That is what my book BLOODRIGHT explains in

TOTO: So the Constitution does not bar the
foreign-born from the presidency. It bars those
who are NOT natural born citizens. Those are
different things. And getting that distinction
wrong in a public constitutional argument is the
kind of error that lets the left dismiss the entire
case.
TOTO: Now — having made that correction —
let me say something about where Nancy Mace
IS headed with this argument. Even if the
constitutional text does not support her exact
framing — the underlying concern is legitimate.
And perhaps it is time to have a serious national
conversation about whether we need a
constitutional amendment. An amendment that
does what the current Constitution does not —
explicitly bar foreign-born citizens from serving
in Congress, the federal judiciary, and other
high offices of the Republic. Not because
foreign-born Americans cannot be patriotic. But
because the Founders understood something
Justice Story said plainly: the natural born
requirement interposes a barrier against the
corrupt interference of foreign governments in
American governance. That concern does not
stop at the presidency. It applies to every
branch. And the fact that Omar and Jayapal and
others sit in Congress with documented foreign
sympathies is exactly the real-world proof that
the Founders’ instinct was correct and should
perhaps be extended.
TOTO: The amendment Mace is proposing may
be the right conversation for this moment. It
would require a two-thirds majority in both
chambers and ratification by three-fourths of
states — a high bar. But the right conversations
are worth having even when the bar is high.
And I want to say something to Toto-Town right
now. I AM GLAD Nancy Mace is having this
conversation. I am glad she introduced this
resolution. I am glad the political class is finally
being forced to grapple with it. Because this
conversation — this EXACT conversation —
began on this broadcast five years ago. Long
before Nancy Mace. Long before the Federalist
published their settlers not immigrants article.
Long before it was safe to say in polite
company. Professor Toto was here. Asking it.
Teaching it. Taking the heat for it. And now a
sitting United States Congresswoman is
introducing legislation on the same principle.
On the floor of the people’s House. On the
official record of Congress. I told you so.
Tomorrow’s News Today. That is what this
broadcast is for.
TOTO: Now — let me show you what Mace’s
proposal triggered. Because the REACTION is
more revealing than the proposal itself.
Jonathan Turley — a man of the establishment
right — posted on X that he cannot think of
anything more antithetical to our founding than
barring foreign-born citizens from Congress. He
said: as a nation of immigrants, it is a
reaffirmation of our heritage to have these
citizens serve in government. And then he said
— the Founders themselves were immigrants.
TOTO: Jonathan. No. They were not. Of the 56
signers of the Declaration of Independence —
only eight were not born in the American
colonies. They were born in England, Ireland,
Scotland, Wales, and the British Caribbean
colonies — Alexander Hamilton was born in
Nevis in the West Indies. But here is what every
single one of them had in common. They were
all subjects of the British Crown. Every one of
them came from within the same Empire. The
Caribbean was part of the Empire. England was
part of the Empire. Ireland was part of the
Empire. They did not cross from a foreign
civilization into America. They moved within the
bounds of the same Crown, the same legal
tradition, the same language, the same broadly
Protestant culture, the same common law
inheritance. And when they broke from the
mother country in 1776 — they were not
immigrants who had arrived to take advantage
of someone else’s system. They were
SETTLERS who had built the system
themselves. And they built it for their posterity.
Not for the whole world. For their posterity.
TOTO: Now — Turley is a columnist. Let me
tell you about someone whose error concerns
me far more. Supreme Court Justice Neil
Gorsuch recently declared that America is —
and I am quoting — a creedal nation. What does
that mean? It means that instead of being a
distinct people descended from common
ancestors, America is a set of Enlightenment
propositions about human nature that anyone
can adopt. All you have to do to become an
American is assent to those propositions and
sign some documents. A recent arrival from
Somalia — so long as he has his paperwork in
order — is just as American as someone whose
family has been here since the seventeenth
century.
TOTO: Justice Gorsuch — with the greatest
possible respect for your seat on that Court —
you are wrong. And your error has
consequences that reach far beyond
constitutional theory. The creedal nation
argument is an insidious attempt to redefine
American identity away from the shared bonds
of culture and history that have always defined
a nation. It says America is an idea — not a
people. A proposition — not a civilization. A set
of documents — not a covenant. But the
Founders did not say that. The Preamble says
we the people secure the blessings of liberty to
ourselves and our POSTERITY. Not to the
world. To their posterity.
TOTO: And here is what this argument looks
like on the ground in 2026. A friend of mine was
at the Galleria Mall in Dallas, Texas this week.
He said: I was in Dallas and I didn’t even
recognize it. There were probably 100 people in
the Apple Store. Maybe five white Americans.
The other 95 were Middle Eastern. Muslim. No
cowboy boots. No cowboy hats. No belt buckles.
Nothing Texan. The skating rink — two or three
white faces. These people are here. And they
are NOT here to assimilate. That is what the
creedal nation proposition produces when
applied to a real city over sixty years. Dallas
was built by settlers. The creedal nation myth is
replacing their posterity in real time.
TOTO: Here is the distinction that has been
systematically erased from American civic
education. A SETTLER comes to build. To plant.
To establish. To create something that did not
exist before. The settlers of America did not
come to take advantage of an existing system.
They came to BUILD the system. They cleared
the land. They wrote the charters. They bled at
Valley Forge. They signed the Declaration.
Their children and grandchildren were the
Republic. Their posterity was the intended
beneficiary. An IMMIGRANT arrives after the
building is done. They come to participate in
what others created. That distinction matters
enormously when we ask: who is America for?
The Preamble answers: ourselves and our
posterity. Not the whole world. Not anyone who
signs the paperwork.
The nation of immigrants myth was invented
to erase that distinction. To replace the
covenant people with a revolving door of
anyone who shows up and assents to a
proposition. And it has been so thoroughly
successful that a sitting Supreme Court
Justice now calls America a creedal nation —
as if the blood spilled at Yorktown and
Gettysburg was merely a transaction in
service of a philosophical idea. It was not a
proposition. It was a COVENANT. And
covenants are passed through bloodlines.
Through posterity. Through the natural born
citizens whose inheritance this Republic was
always meant to be.
TOTO: And now the BLOODRIGHT correction.
The Constitution does not merely say foreign-
born citizens cannot be president. It says
NATURAL BORN. And those two things are not
the same. A natural born citizen — as the
Founders understood from Vattel’s Law of
Nations — requires that you be born of citizen
parents on citizen soil. Both conditions. Born
here AND born to citizens. That is what natural
born means. That is what BLOODRIGHT means.
You can be born on American soil to foreign
parents and under the Founders’ framework —
you are NOT a natural born citizen. You hold
citizenship. But you do not hold birthright. And
the presidency was reserved for those who hold
BIRTHRIGHT. Not just paperwork. Get

DEEP DIVE #2: THE GOD YAHWEH vs THE
GOD GOVERNMENT
TOTO: Oh say — does that banner yet wave?
That is tonight’s question. And the answer
depends entirely on something the founders
understood that the modern political class has
deliberately destroyed. The answer depends on
who we worship. Not as a matter of personal
faith. As a matter of national foundation.
TOTO: I want to share something with Toto-
Town tonight that came directly from the
patriots I met at REDEDICATE 250 in
Washington D.C. Because after that anointed,
historical, rain-soaked, heat-drenched day on
the National Mall — I received feedback that I
need to address from this microphone.
TOTO: People told me — Professor Toto,
America is not a Christian nation. People told
me that the rededication event was mixing
religion with politics. People told me the
Founders intended a secular republic. And I
want to respond to every one of those people
tonight with love, with precision, and with the
evidence they have never been shown.
TOTO: Here is the question underneath all of
it. Why do the elites — the globalists, the
academic class, the media establishment, the
secular progressives — why do they work so
tirelessly to remove YAHWEH from the public
square? Why does it matter so much to them
that God be invisible in American civic life?
Think about it. What is the one thing that
stands between the people and total submission
to elite authority? What is the one argument
that cannot be defeated by legislation or court
ruling or media pressure? The argument that
your rights come from YAHWEH — not from
government.
TOTO: If your rights come from YAHWEH —
no government can revoke them. If your rights
come from YAHWEH — no elite can redefine
them. If your rights come from YAHWEH — no
president, no congress, no supreme court, no
world body has authority over them. Because
the authority that granted them is higher than
any earthly power. That is the constitutional
genius of the Declaration of Independence.
Endowed by their CREATOR with certain
UNALIENABLE rights. Unalienable. Cannot be
taken. Cannot be sold. Cannot be legislated
away. Because they did not come from a
legislature.
TOTO: But the moment you replace YAHWEH
with government as the source of rights —
everything changes. Now your rights are no
longer unalienable. They are privileges.
Granted by government. Defined by
government. Limited by government. Revoked
by government. And you are no longer a free
person under YAHWEH. You are a subject of
the state. And the elite class that controls the
state controls you. That is why they want God
out of the public square. Not because they are
atheists. Because they want to BE God. The god
of government is the oldest idol in human
history. And they are building its temple in
Washington D.C. with your tax dollars and your
silence.
TOTO: As long as the American people
worship a God unseen — they will never fully
submit to the elite gods seen. The invisible God
is the firewall between the free people and the
total state. Remove the invisible God — and the
total state has no competition. That is the
agenda. That is always been the agenda. And
REDEDICATE 250 — tens of thousands of
patriots standing in the rain on the National
Mall saying WE BELONG TO YAHWEH — was
the most politically threatening thing those
elites have seen in fifty years. Because you
cannot control a people who are already owned
by a higher authority than yours.
“No man can serve two masters: for either he will
hate the one, and love the other; or else he will
hold to the one, and despise the other. Ye cannot
serve God and mammon.” — Matthew 6:24
TOTO: We must NEVER allow this nation to be
under anything but YAHWEH. One nation under
YAHWEH is not a religious preference. It is a
constitutional declaration of where authority
originates. Remove that declaration — and you
have not created a secular nation. You have
created a nation under government. Under
elites. Under the visible gods of power and
money and control. And Professor Toto will
stand against that — from this microphone —
until his last breath.

SEGMENT 3 — THE LAND️
OF OZ
TOTO: Welcome to the Land of Oz — where
nothing makes sense, everything is political,
and the enemies of the posterity of the
Founders are running the show.
OZ STORY #1: THE PARTY THAT HATES
YOUR CHILDREN
TOTO: One hundred and ninety-eight
Democrat members of Congress just voted — on
the record, by name — to allow schools to
secretly change your child’s gender identity,
name, and pronouns without your knowledge
and without your consent. One hundred and
ninety-eight. And only eight Democrats broke
ranks to stand with parents. In the Land of Oz
— the school board has more authority over
your child’s identity than the father and mother
who brought that child into the world. The party
that calls itself the party of the people just
voted to take your children from you — one
pronoun at a time. Oh say — does that banner
yet wave over a nation where Congress votes to
hide your children from you? Toto-Town — you
know every one of those 198 names comes
November.
OZ STORY #2: THE CREEDAL NATION —
WHERE ANYONE CAN BE A FOUNDER
TOTO: And in the Land of Oz — Supreme
Court Justice Neil Gorsuch just told the world
that America is a creedal nation. A proposition.
A set of Enlightenment ideas that anyone can
adopt by signing the right documents. In the
Land of Oz — the man who bled at Valley Forge
and the man who arrived at JFK Airport last
Tuesday are equally American. In the Land of
Oz — posterity is just a word in the Preamble
that nobody is meant to take seriously. In the
Land of Oz — the settlers who built this
Republic have no greater claim on its
inheritance than anyone who can recite the
pledge on the way through customs. Oh say —
can you see — by the dawn’s early light — what
we so proudly built — being signed away by a
man in a black robe who calls it progress? In
the Land of Oz — the Founders were
immigrants. Jonathan Turley said so. And
Professor Toto said: Jonathan. No. They were
not.
SEGMENT 4 — I TOLD YOU
SO
[ I TOLD YOU SO FANFARE ]
THE DALLAS MALL IS THE 1965 PROPHECY
IN REAL TIME
TOTO: I have been teaching you about the
1965 Immigration Act for years. I have been
showing you the numbers. The twelvefold
increase in immigration since 1965. The Muslim
population that went from virtually zero to 4.5
million. The demographic transformation of the
most covenant-built nation in human history.
And some of you listened. And some of you
called it fearmongering.
TOTO: My friend just walked through the
Galleria Mall in Dallas, Texas. The city that
Roger Staubach built. The city that Jim Wright
governed. The city where JFK was assassinated
by a Marxist and the left blamed the
conservative political culture. That city. That
mall. Five white Americans out of one hundred
in the Apple Store. A skating rink where you
might find two or three white faces. No cowboy
boots. No cowboy hats. No belt buckles.
Nothing Texan.
TOTO: I told you so. Not with pleasure. With
grief. Because I love this country. And I love
Texas. And I am watching what LBJ’s lie at
Liberty Island in 1965 has produced in one
generation in one shopping mall in one
American city. The settlers built Dallas. Their
posterity is being replaced. And the creedal
nation myth that Gorsuch just validated from
the Supreme Court is the philosophical
justification for why nobody is supposed to
notice or care.
TOTO: I notice. I care. And I will keep saying
so from this microphone regardless of what
they call me for saying it.

MONOLOGUE
"THE LIE THAT BANNED GOD
FROM AMERICA"
The Constitutional Fraud of Separation of Church and State
— And Why the Left IS a Religion
[ MONOLOGUE TRANSITION — MUSIC DOWN —
PROFESSOR STANDS ALONE ]
PART 1: THE PHRASE THAT IS NOT IN THE
CONSTITUTION
TOTO: I want to start tonight’s monologue
with a pop quiz. Open your pocket Constitution.
Go to the First Amendment. Read it with me.
Congress shall make no law respecting an
establishment of religion, or prohibiting the
free exercise thereof. Read it again. Slowly.
Every word. Now — find me the phrase
separation of church and state. Find it. I will
wait.
TOTO: You cannot find it. Because it is not
there. It has never been there. It will never be
there. Because the Founders never wrote it.
The Constitution does not ban religion from
government. It bans government from
CONTROLLING religion. Those are not the
same thing. They are the exact opposite of the
same thing. And Trump’s Religious Liberty
Commission — chaired by Texas Lieutenant
Governor Dan Patrick — said it officially on the
record at the Museum of the Bible on April
13th, 2026: there is no such thing as separation
of church and state in the Constitution. For too
long the anti-God left has used this phrase to
suppress people of religion in our country. The
lie has been named. Officially. In Washington.
On the record.
PART 2: WHERE THE PHRASE ACTUALLY
CAME FROM
TOTO: So where did it come from? A private
letter. Thomas Jefferson — writing to the
Danbury Baptist Association in 1802 — used the
metaphor of a wall of separation. A private
letter. Not legislation. Not constitutional text.
Not a court ruling. And here is the beautiful
irony the secularists never mention: Jefferson
wrote that letter to PROTECT THE CHURCH
from the government — not to protect the
government from the church. The wall was built
to keep the government OUT of the church. Not
to keep the church out of the government.
Supreme Court Chief Justice William Rehnquist
wrote in dissent: the wall of separation between
church and state is a metaphor based on bad
history, a metaphor which has proved useless
as a guide to judging. It should be frankly and
explicitly abandoned.
PART 3: THE EVIDENCE CARVED IN STONE
TOTO: Now let me show you the evidence the
Founders built into the architecture of the
Republic itself. The Lincoln Memorial — In God
We Trust engraved in its walls. The Jefferson
Memorial — I have sworn upon the altar of God
eternal hostility against every form of tyranny
over the mind of man. The Supreme Court
building — Moses holding the Ten
Commandments carved above the entrance. The
Library of Congress — Psalm 19:1 in stone: The
heavens declare the glory of God. Our money —
IN GOD WE TRUST on every bill and coin. The
Pledge — one nation UNDER YAHWEH. The
Declaration — endowed by their CREATOR with
certain unalienable rights. Find me the secular
nation in that evidence. You cannot. Originalism
demands we interpret the Constitution
according to the INTENT of those who wrote it.
And their intent is carved on every building in
Washington D.C.
PART 4: BEN FRANKLIN COMES AROUND
TOTO: And for those who say the Founders
were deists who did not believe in a personal
God — I give you Benjamin Franklin. The oldest
delegate at the Constitutional Convention. The
most skeptical Founder. June 28th, 1787. The
Convention is deadlocked and near collapse.
Franklin rises and says:
“I have lived a long time. And the longer
I live the more convincing proofs I see of
this truth — that God governs in the
affairs of men. And if a sparrow cannot
fall to the ground without His notice — is
it probable that an empire can rise
without His aid?”

On the floor of the Constitutional Convention.
Calling the nation to prayer. The most skeptical
Founder came around. On the very floor that
produced the document the secularists claim
bans God from public life.
PART 5: THE LEFT IS A RELIGION
TOTO: And now I want to make something
plain that the left will never admit but that the
evidence demands. The left is a religion. Not a
metaphor. Not an analogy. A functioning,
operating, doctrinally enforced RELIGION. With
its own orthodoxy — the approved doctrines you
must affirm: climate change, DEI, gender
ideology, open borders, abortion as sacrament.
Its own heresy — disagree and you are not
merely wrong, you are EVIL, canceled,
destroyed. Its own priesthood — the academics,
journalists, and fact-checkers who decide what
is true. Its own sacraments — the pronoun, the
land acknowledgment, the performative
confession of privilege. Its own saints — RBG,
Fauci, Obama, George Floyd elevated to
iconography. Its own devils — Trump,
Christians, conservatives, the deplorables. And
its own creation myth — history as the march
from oppression toward liberation with the
state as the instrument of salvation.
TOTO: That is not politics. That is theology
without God. And here is the constitutional
bombshell. The left used the fake doctrine of
separation of church and state to ban the real
religion — Christianity — from the public
square. While simultaneously installing their
own religion — leftism — in every public school,
government agency, corporate HR department,
and court in America. They did not separate
church and state. They replaced one religion
with another. And then told you the
replacement was secular. It is not secular. It is
a cult. And it is the established religion of the
modern American state — in direct violation of
the very First Amendment they claim to be
defending.
THE CLOSE — DOES THAT BANNER YET
WAVE?
TOTO: And so we return to the question. The
only question that matters tonight. The question
Francis Scott Key asked through the smoke and
fire of a British bombardment. He could not see
clearly. And he asked — OH SAY — does that
Star Spangled Banner yet wave? Every
generation must answer. Not once. Every
generation. And tonight Professor Toto gives
you the answer that the enemies of the
posterity of the Founders do not want you to
speak out loud.
TOTO: The banner is not threatened by a
foreign navy tonight. It is threatened by internal
combustion. By the forgetting of our Western
ways. By the replacement of YAHWEH with
government. By the creedal nation myth that
tells settlers their posterity has no greater
claim on this Republic than anyone who signs
the paperwork. By the 198 Democrats who
voted this week to take your children from you
one pronoun at a time. By the separation of
church and state lie that banned the invisible
God so the visible gods of elite power could
take His place. The banner cannot wave — it
WILL NOT wave — as long as the enemies of
the posterity of the Founders remain in control
of our schools, our courts, our Congress, and
our culture.
TOTO: America is a covenant nation. Founded
on the premise that rights come from YAHWEH
— not from government. That law stands above
kings because a higher Law stands above law.
Remove YAHWEH from America and you do not
have a secular nation. You have a nation with
no foundation. And a nation with no foundation
falls. The Founders built that foundation. The
settlers bled for it. Their posterity inherited it.
And this generation — OUR generation — must
answer the question.
TOTO: Does that banner yet wave? O’er the
land of the free and the home of the brave?

Because one nation under YAHWEH is not a
religious preference. It is the only thing
standing between the free people and the total
